Welcome to No Kidding (“No Kidding,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the No Kidding mobile application and related services (the “App”). By using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility and Accounts
Parents/Guardians- Must be at least 18 years old to create an account.
- May create and manage profiles for their children (“Participants”).
- Are fully responsible for supervising their child’s participation in any activity organized through the App.
- Must be at least 18 years old to create a coach account.
- Are responsible for following all safety guidelines and local laws when organizing or supervising activities.
- Minors may not create accounts or access the App independently.
2. Parental Consent
By creating a profile for a child, you confirm that you are the parent or legal guardian and that you consent to:
- Your child’s participation in running activities and events organized through No Kidding.
- The collection and processing of your child’s information as described in our [Privacy Policy].
- Accepting responsibility for your child’s safety and behavior during participation.
3. Assumption of Risk
Running activities carry inherent risks, including but not limited to injury, illness, accidents, dehydration, and exposure to weather conditions. By using the App and allowing your child to participate, you acknowledge and accept these risks.
4. Liability Waiver
To the fullest extent permitted by Florida law, you agree to release, indemnify, and hold harmless No Kidding, its owners, employees, partners, and affiliates from any claims, damages, or liabilities arising from participation in activities organized through the App, except in cases of gross negligence or intentional misconduct.
5. Privacy
We comply with the Children’s Online Privacy Protection Act (COPPA). Parents and guardians control all personal information related to children on the App. For details on how we collect, use, and protect information, please review our [Privacy Policy].
6. Code of Conduct
All users (parents and coaches) must adhere to our Code of Conduct, which outlines safety, behavior, and community guidelines. Violation of the Code may result in suspension or removal from the App.
7. Termination
We may suspend or terminate your account if you violate these Terms, our Code of Conduct, or engage in behavior that endangers participants or misuses the App.
8. Modifications to Terms
We may update these Terms periodically. Significant changes will be communicated via email or in-app notification. Continued use of the App after updates indicates your acceptance of the revised Terms.
9. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
CODE OF CONDUCT
This Code of Conduct outlines the safety and behavior standards for all users of the No Kidding app. By using the App, parents/guardians and coaches agree to follow this Code to ensure a safe and positive environment for all participants.
1. Purpose
- Promote safety and inclusivity in all youth running activities.
- Clarify responsibilities for parents, guardians, and coaches.
- Encourage positive behavior and community values.
Failure to follow this Code may result in suspension or removal from the App.
2. Expectations for Parents and Guardians
Supervision and Safety- Always supervise your child during activities or ensure another responsible adult is present.
- Ensure your child wears appropriate footwear, clothing, and hydration equipment for each activity.
- Approve your child’s participation in events or meetups before they join.
- Communicate respectfully with coaches and other parents.
- Address concerns or incidents promptly through the appropriate in-app reporting tools or contact form.
- Encourage your child to treat other participants respectfully.
- Ensure your child follows event rules, safety guidelines, and coach instructions.
- Refrain from disruptive or unsafe behavior during events.
3. Expectations for Coaches
Safety and Planning- Plan routes that prioritize participant safety (e.g., avoid heavy traffic, ensure adequate lighting).
- Monitor all children during activities and ensure group safety at all times.
- Prepare for emergencies (carry a phone, know basic first aid procedures).
- Maintain appropriate boundaries with youth participants.
- Communicate activity details and updates directly with parents/guardians, not minors.
- Protect participant information — never share, sell, or misuse personal data.
- Foster an environment free from bullying, harassment, or discrimination.
- Encourage all participants, regardless of ability level, to enjoy running and stay active.
4. General Safety Guidelines for Everyone
- Use safe running areas (parks, trails) and avoid unsafe conditions (e.g., extreme weather).
- Wear reflective gear or lights when running in low-light conditions.
- Keep music or audio devices at a moderate volume to stay aware of surroundings.
- Gradually increase running distance and intensity to prevent injuries.
- Report safety concerns or misconduct immediately through the app.
5. Violations
- Warnings or reminders to follow safety protocols.
- Temporary suspension of account access.
- Permanent removal from the App in severe or repeated cases.
6. Updates to the Code
We may update this Code to reflect evolving safety standards or community feedback. Updates will be posted in the App, and continued use means you accept the revised Code.
